Terms & Conditions
These Terms govern access to natureoriginal.gifts and purchases from Nature Original | Gift Shop. The seller under these Terms is Organic Digital Studio Pty Ltd. By placing an order, you agree to these Terms and the policies incorporated by reference.
1. Scope and acceptance
These Terms apply to website visitors, account holders and customers. Our Shipping & Delivery Policy, Returns & Refunds Policy, Privacy Policy and Cookie Policy form part of the terms applicable to your use of the site or purchase. If a mandatory law gives you rights that conflict with these Terms, that law prevails to the extent of the conflict.
2. Eligibility and accounts
You must have legal capacity to enter a purchase contract and must provide complete, current and accurate information. If you use an account, you are responsible for safeguarding its credentials and for activity carried out through it. Tell us promptly at [email protected] if you suspect unauthorised use. We may suspend access where reasonably necessary to protect customers, the site or payment systems from misuse, fraud or security risk.
3. Product information
We take reasonable care to present product descriptions, specifications, dimensions, materials, prices and availability accurately. Measurements may be approximate and should be checked before ordering. Accessories, props or styling objects shown in photographs are not included unless the listing states otherwise. A reference to a material describes the relevant product component and does not imply that every component is made from that material.
Product photographs are intended to represent the item accurately, but lighting, photography and display settings can affect appearance. Screen colours are not perfectly uniform. These ordinary presentation differences do not permit us to supply a materially different product.
4. Natural and hand-finished variation
Products made from or incorporating wood, stone, mineral-like material, bamboo, rattan, natural fibres, woven material, ceramic or other naturally variable or hand-finished material may differ modestly from photographs, samples, another unit or another customer’s item. Expected differences may include grain, tone, colouring, pattern, knots, markings, fibres, weave, texture, surface characteristics, hand-finished details and minor dimensional differences within reasonable manufacturing tolerances.
Reasonable variation that remains consistent with the product description is part of the product’s character and is not, by itself, a defect, damage or misdescription. This clause does not excuse a genuine defect, significant damage, an incorrect item or a substantial departure from the advertised description.
5. Prices and currencies
Prices are shown in the currency selected by the site’s location and session system: ordinarily AUD for visitors detected in Australia and USD elsewhere. The currency shown in the cart and checkout is the currency submitted for payment. Your card issuer or payment provider may apply its own conversion rate or international transaction fee. We do not control those charges.
Prices may change prospectively. A change does not affect an accepted order except where the displayed price was an obvious error that a reasonable customer would have recognised. If an obvious pricing or listing error affects an order, we may contact you for instructions or cancel and refund the affected amount before fulfilment, to the extent permitted by law.
6. Taxes, duties and import charges
Taxes collected by us will be shown where applicable. International orders may attract import duties, taxes, brokerage or customs charges imposed by the destination country. Unless checkout expressly states that a charge is included, the recipient is responsible for destination charges to the extent permitted by law. We do not control customs assessments or clearance timing.
7. Payment and fraud screening
You confirm that you are authorised to use the payment method submitted. Payment is handled through the payment options presented at checkout. An authorisation or charge does not by itself mean an order has been accepted. We may use proportionate fraud, identity, address and payment checks and may request reasonable verification before accepting or fulfilling an order. We may refuse or cancel an order where there is a reasonable fraud, sanctions, security or payment risk. Any amount captured for a cancelled order will be returned as required.
8. Orders and acceptance
Submitting an order is an offer to buy the selected goods. An automated confirmation records receipt of that offer; acceptance occurs when we expressly accept the order or begin fulfilment, depending on the circumstances. We may reject or cancel an order before acceptance for legitimate reasons including unavailable stock, delivery restrictions, payment failure, suspected fraud, an obvious error or inability to fulfil the order lawfully. We will not reject an order for a prohibited discriminatory reason.
Product and fulfilment availability can change. If an ordered item becomes unavailable, we may offer an alternative only with your agreement where the alternative would be materially different. Otherwise, we may cancel the affected item and issue the appropriate refund. We do not substitute materially different goods without consent.
9. Changes and cancellations
Contact [email protected] immediately if an order is incorrect. A requested change or cancellation is not guaranteed after processing or fulfilment begins. If we can stop the order without incurring irreversible costs, we will do so. Our no-change-of-mind position and any applicable mandatory cancellation rights are explained in the Returns & Refunds Policy.
10. Shipping and delivery
The Shipping & Delivery Policy applies to processing, tracking, multiple parcels, international fulfilment, customs, delivery estimates, delays, failed delivery and loss in transit. Processing time and carrier transit time are separate. Delivery dates are estimates unless expressly identified as guaranteed. You must provide a complete deliverable address and review it before submission. Once fulfilment begins, an address change may not be possible.
Where an incorrect or incomplete customer-supplied address, refusal, failure to collect or failure to follow carrier instructions causes redelivery, return or loss, we may recover reasonable resulting costs or deduct them from a voluntary refund where lawful. This does not limit remedies for a failure caused by us or rights that cannot be excluded.
11. Inspection, damage and missing items
Inspect the order reasonably promptly after delivery. If an item is damaged, defective, incomplete, materially misdescribed or incorrect, follow the evidence and notification process in the Returns & Refunds Policy. Keep the product, packaging and shipping label while the issue is assessed. Multiple items may arrive separately, so a partial delivery is not necessarily a missing-item event.
12. Returns, refunds and mandatory remedies
Nature Original does not offer voluntary returns or refunds merely because a customer changes their mind. The complete rules and claim process appear in the Returns & Refunds Policy. This position does not exclude remedies for defective, damaged, materially misdescribed or incorrectly supplied goods where applicable law requires a remedy. Depending on the law and circumstances, an available remedy may include repair, replacement, resupply, an agreed partial refund or a full refund.
13. Chargebacks and payment disputes
Please contact us first so that a genuine issue can be investigated efficiently. Nothing in these Terms waives a right to dispute a card transaction. We may contest an improper or duplicate chargeback and provide the payment provider with relevant order records, delivery evidence, communications, product evidence and applicable policies. Starting a chargeback does not create entitlement to both a chargeback credit and a separate refund for the same amount.
14. Acceptable website use
You must not use the site unlawfully; interfere with its operation or security; introduce malicious code; scrape or automate access in a manner that creates unreasonable load; attempt unauthorised access; impersonate another person; submit false information; infringe intellectual property; manipulate reviews; or use an account, promotion, payment method, claim process or chargeback process fraudulently. We may take proportionate steps to prevent or investigate misuse.
15. Intellectual property
The Nature Original name, site design, original text, graphics and original media are owned by or licensed to the seller. You receive a limited, revocable, non-transferable right to use the site for lawful personal shopping and information. No other licence is granted. Third-party marks and product materials remain the property of their respective owners.
16. Third-party services
The site relies on third-party payment, hosting, security, communications, fulfilment and delivery services. Their separate terms may apply to services they provide directly. We remain responsible for our own obligations and do not use third-party arrangements to avoid mandatory customer rights.
17. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the contract was formed, or for loss caused solely by events outside our reasonable control. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or applicable mandatory consumer guarantees. Where a lawful limitation is permitted, liability will be limited to the remedy or amount permitted by the applicable law.
18. Customer responsibility and indemnity
You are responsible for loss directly caused by your unlawful use of the site, deliberate misuse, fraud or infringement of another person’s rights. To the extent enforceable, you will reimburse reasonable loss and expense directly resulting from that conduct. This clause does not make you responsible for our negligence, breach or matters outside your control and does not limit mandatory consumer rights.
19. Events outside reasonable control
Neither party is responsible for delay caused by an event genuinely outside its reasonable control, including severe weather, natural disaster, epidemic, war, civil disruption, government action, customs disruption, industrial action, transport interruption or major network failure. This clause does not excuse payment already due, require a customer to wait indefinitely or remove a remedy required by law. If performance becomes impossible or excessively delayed, we will provide an appropriate lawful solution.
20. Governing law and international customers
These Terms are governed by the laws applicable to the seller in Australia. Courts with competent jurisdiction in Australia may hear disputes, subject to any mandatory jurisdictional right available to a customer. This choice does not deprive a customer of non-waivable consumer protection in the country or state where that customer resides.
21. General provisions
If part of these Terms is unlawful or unenforceable, it will be read down or severed to the minimum extent necessary without affecting the remainder. A delay in enforcing a right is not a waiver. These Terms and the incorporated policies form the agreement concerning the online purchase, together with the order confirmation and any terms expressly agreed in writing. We may update these Terms prospectively; the version in force when an order is placed governs that order unless a mandatory law requires otherwise.
